2. Responsibilities

2.2. The Company undertakes that the user will benefit from the contracted services, except in cases of technical failure.

2.3. The User agrees not to engage in reverse engineering of the site or attempt to discover or obtain its source code; otherwise, the User accepts responsibility for any damages that may arise and that legal and criminal proceedings may be initiated.

2.4. The User agrees not to produce or share any content within the site that is immoral, illegal, misleading, offensive, obscene, infringing on personal rights or copyrights, or promotes illegal activity. In such cases, the User is solely responsible, and Website administrators reserve the right to suspend or terminate accounts and initiate legal action. The Company also reserves the right to share user information with judicial authorities if requested.

 

3. Intellectual Property Rights

 

3.1. 6.2. The User is responsible for maintaining the confidentiality of their passwords and account information. The Company is not responsible for any data losses or security breaches resulting from the User’s failure to protect their credentials.

 

7. Force Majeure

 

7.1. In the event of force majeure events outside the control of either party (such as natural disasters, war, riots, infrastructure failures, pandemics, etc.), obligations under this agreement are suspended, and neither party will be held liable.

 

8. Entire Agreement and Enforceability

 

8.1. If any provision of this agreement is deemed partially or wholly invalid, the remainder of the agreement shall remain in effect.

 

9. Amendments

 

9.1. The Company may change the services and terms of this agreement at any time. Changes become effective upon publication on the Website. The User is responsible for tracking such changes, and continued use constitutes acceptance of the updated terms.

 

10. Assignment

 

10.1. The Company may assign this agreement in whole or in part without notice. The User may not assign this agreement to another party. Such attempts will be deemed invalid.

 

11. Notices

 

11.1. All notices related to this agreement will be sent to the Company’s known email address and to the email address provided by the User in their registration. Users must inform the Company of any changes to their email address within 5 days, or notices sent to the previous address will be considered valid.

 

12. Effectiveness and Acceptance

 

12.1. This Terms of Use Agreement comes into effect upon publication on the Website. By continuing to use the Website, the User is deemed to have accepted these terms. The Company may update the terms at any time, with version number and date noted, effective upon publication.

 

13. Evidence Agreement

 

13.1. In the event of any dispute, the parties agree that Company records, logs, and electronic data will be considered valid evidence under Article 6100 of the Civil Procedure Code and that the User will not dispute these records.

 

14. Dispute Resolution

 

14.1. Any disputes arising from the implementation or interpretation of this agreement will be resolved by the courts and enforcement offices of Batman, Türkiye.
